Law Professor Edge Kanyongolo Accuses Minister of Information Mark Botomani of Misleading the Nation

Professor Kanyongolo said this following a press statement issued by the minister on Tuesday on the status of o the Honourable Chief Justice’s tenure of office.
In the statement, Botomani said there is nothing political in sending one to leave pending to his retirement as other people are putting it.
Speaking today during lawyers’ peaceful march in defense of the judiciary independence, Kanyongolo asked the minister to stop misleading the nation.

Breakthrough as scientist prove 1st life-saving drug of Covid-19

A cheap and widely available drug can help save the lives of patients seriously ill with coronavirus.
The low-dose steroid treatment dexamethasone is a major breakthrough in the fight against the deadly virus, UK experts say.
The drug is part of the world's biggest trial testing existing treatments to see if they also work for coronavirus.
It cut the risk of death by a third for patients on ventilators. For those on oxygen, it cut deaths by a fifth.
Had the drug had been used to treat patients in the UK from the start of the pandemic, up to 5,000 lives could have been saved, researchers say.
Prime Minister Boris Johnson said there was a genuine case to celebrate "a remarkable British scientific achievement", adding: "We have taken steps to ensure we have enough supplies, even in the event of a second peak."
Chief Medical Officer for England Prof Chris Whitty said it would save lives around the world.
About 19 out of 20 patients with coronavirus recover without being admitted to hospital.
Of those who are admitted, most also recover but some may need oxygen or mechanical ventilation.
And these are the high-risk patients dexamethasone appears to help.
The drug is already used to reduce inflammation in a range of other conditions, including arthritis, asthma and some skin conditions.
And it appears to help stop some of the damage that can happen when the body's immune system goes into overdrive as it tries to fight off coronavirus.
This over-reaction, a cytokine storm, can be deadly.
In the trial, led by a team from Oxford University, about 2,000 hospital patients were given dexamethasone and compared with more than 4,000 who were not.
For patients on ventilators, it cut the risk of death from 40% to 28%.
For patients needing oxygen, it cut the risk of death from 25% to 20%.
Chief investigator Prof Peter Horby said: "This is the only drug so far that has been shown to reduce mortality - and it reduces it significantly. It's a major breakthrough."

Gvt insists Nyirenda should go on leave

Government insists that Chief Justice Andrew Nyirenda has accumulated more than 572 leave days and hence, should proceed on leave pending his retirement.
In a statement issued last night, government Spokesperson and Information Minister Mark Botomani maintains an earlier position made in a communiqué by Chief Secretary to government Lloyd Muhara on June 12, 2020.
“Government further observes that the Chief Justice will not be the first judicial officer to have proceeded on leave pending retirement.” Said the statement in part.
The statement cites retired Chief Justices Lovemore Munlo and Anastazia Msosa who both proceeded on leave pending retirement from the Office of Chief Justice of Malawi.
“It is for this reason that Government finds it proper that the Chief Justice Andrew Nyirenda should enjoy his leave days, with his family, while still enjoying full benefits of his office,” the statement added.
The Botomani statement is coming just a few days after two injunctions were obtained, restricting the executive from effecting the action pending judicial review.
There has also been widespread local and international condemnation against usurping the powers of the judiciary and lawyers in the country are today holding demonstrations in defence of judicial independence and the rule of law.

Bakili Muluzi Backs Fyness Mwagonjwa’s Tribalism Remarks

Former President Bakili Muluzi has come to the defense of Democratic Progressive Party’s youngest lawmaker Fyness Magonjwa on the remarks she made in Machinga threatening traditional leaders with consequences if they ever entertain opposition leaders in the district.
The Machinga South East Constituency legislator faced backlash from opposition supporters and other stakeholders after uttering the words that were deemed as “tribally”.
However, Former President Bakili Muluzi has backed the legislator by reminding people that when Joyce Banda had a shade from the president Peter Mutharika, everyone came out to defend “a woman” but when this “courageous” young and “charismatic” lady stood up and exercised her right to freedom of speech, many insulted her without seeing she’s a woman.
“Our country has become lovers of politicians than lovers of the nation.
“I defeated the Kamuzu regime but, whenever he did right things, we were clapping hands and whenever he did wrong, we were protesting.
“This young democratic was not wrong to speak about the right things to applaud in DPP. That is real democracy,” Muluzi said.

HRDC Endorses Lawyers’ Protest

Human Rights Defenders Coalition (HRDC) has endorsed demonstrations planned by lawyers slated for Wednesday against the Executive arm of government’s interference on the Judiciary.
On June 12, Chief Secretary to the government Lloyd Muhara, released a press statement announcing the said retirement of the chief justice which attracted mixed reactions from different quarters.
In a bid to make sure that the judiciary remains independent when discharging its duties, lawyers across the country have planned to hold protest against government’s decision tomorrow.
In a statement signed by the coalition’s chairperson Gift Trapence, HRDC said it is the judiciary’s mandate to interpret, protect and enforce the Republic Constitution and all laws.
HRDC added that the judiciary has to fulfill its mandate in an independent and impartial manner with regard to only relevant facts and the prescription of law
“All matters relating to welfare and discipline of the Chief Justice are an exclusive realm of the Judicial Service Commission,” writes HRDC.
The Human Rights defenders also stressed that any attempts by the Executive to get involved in the internal affairs of the judiciary is trespassing and capture of the judiciary in Malawi.
HRDC has therefore endorsed the lawyers demonstrations saying it is a justified and peaceful demonstrations.
“We at the Human Rights Defenders Coalition-HRDC- fully endorse the decision by lawyers in this country to take to the streets tomorrow on June 17, 2020,” HRDC said.
“This is a justified and peaceful demonstration of dismay at the conduct of the Peter Mutharika administration, in the manner he has tried to capture the judiciary in our country by illegally changing the existing structure of the leadership in the justice delivery system for his personal political interests.”

In comparison, 33% said they will vote for President Peter Mutharika and runningmate Atupele Muluzi of the DPP-UDF alliance in the 23 June 2020 fresh presidential election.
